Job Description:
Purpose of Position
To provide specialized legal assistance, case management, and administrative support for the litigation lawyers on staff with the Litigation and Enforcement department.
Key Responsibilities
Drafts/prepares or reviews a broad range of documentation for legal proceedings, including pleadings, orders, affidavits, correspondence, and other legal documents, consistent with the applicable rules of practice or procedure for the Financial Services Tribunal or Courts.
Manages all aspects of document management, production, and disclosure, including collecting, organizing, managing, coding, indexing, redacting, and summarizing voluminous electronic and hard copy documents and evidence; coordinates the storage and retrieval of records.
Maintains litigation and enforcement files to a high degree of organization, ensuring accessibility, completeness, and continuity of case administration.
Monitors the status of files including all timelines; maintains department file list, and prepares monthly statistics and a monthly report tracking, as required.
Provides end-to-end administration of litigation and enforcement files including opening and closing files, processing expenses, and liaising with other departments within FSRA to ensure the publication and execution of Orders or other enforcement actions.
Corresponds with Financial Services Tribunal, courts, external counsel, opposing parties, process servers and other partners and suppliers.
Conducts various research and searches, and reviews resulting records and other documents to identify legal or factual information; summarizes research for the review of Counsel.
Receives, reviews, analyzes, and responds to requests for information under the Freedom of Information and Protection of Privacy Act (FIPPA).
Supports and champions the development and implementation of new processes, procedures, and technology tools.
Organizes and coordinates meetings, appointments, and conferences.
Commissions affidavits and sworn declarations as a Commissioner of Oaths.
Provides training on internal processes, systems, practices, and procedures.
Qualifications
Education and Experience
Diploma from a recognized Ontario Law Clerk program certified with The Institute of Law Clerks of Ontario
Must be eligible for membership in the Institute of Law Clerks of Ontario.
5+ years of experience working as a Litigation Law Clerk, preferably in a regulatory environment.
Knowledge and Skills
Excellent interpersonal skills and ability to work independently with minimal supervision, as well as in a group alongside all levels and departments of the organization
Excellent communication (verbal and written) skills.
Superior writing skills including the ability to compile information from files in order to draft documentation.
Excellent knowledge of legal terminology, legal forms, and procedures.
Professionalism and ability to take accountability for providing timely and accurate responses to inquiries from internal and external stakeholders.
High level of judgment/organizational skills and initiative to deal with varied duties along with the ability to work well under pressure and take ownership in supporting the team.
Knowledge of the Freedom of Information and Protection of Privacy Act (FIPPA) and the ability to exercise discretion when dealing with sensitive, highly confidential matters.
Advanced technical proficiency with MS Office (Word, Excel, PowerPoint, and Outlook), and legal records/document management software, eDiscovery/analytics software, and SharePoint.
Knowledge and experience with regulatory sectors and governing statutes is an asset.
