The VP, Senior Legal Counsel – Underwriting, is responsible for providing support to the Bermuda Underwriting and the Global Claims functions to identify, manage and reduce litigation and dispute risk across the company’s reinsurance operations. The successful candidate reports to the SVP, Senior Counsel – Underwriting, and is expected to collaborate closely with peers in other offices to assure consistency of approach across our global operations.
Underwriting Responsibilities Include:
- Ensures that Bermuda underwriters understand how our legal rights and obligations are impacted by wordings and related issues.
- Alongside the SVP, Senior Counsel – Underwriting, acts as a resource for contract wordings issues for Property, Casualty, and Specialty assumed and ceded reinsurance contracts.
- Assists with production and review of confidentiality agreements/clauses review, consulting and licensing agreements tied to business operations, and other “operational” agreements, e.g. trust agreements, commutation agreements, settlement agreements, etc.; and
- Direct interaction with underwriters, clients, brokers, and banks, advising on and negotiating treaty wordings, NDAs, trust agreements, and other legal and regulatory issues.
- Represents the Company in public-facing presentations and educational fora.
- Providing legal support for the run-off and resolution of acquired “sidecar,” third-party capital, and similar facilities.
- Assist in the development and roll-out of technology-enabled tools for the improved efficiency and performance of the legal underwriting team.
Global Claims Responsibilities Include:
- Provides legal support to the Global Claims function with respect to assumed and ceded reinsurance claims arising out of a variety of classes of business, including property catastrophe, excess casualty, specialty, and credit lines of business.
- Assists the SVP, Chief Counsel – Underwriting & Litigation, and others to manage formal and informal legal proceedings and disputes in respect of our reinsurance operations, including supervising external legal counsel and managing e-discovery processes.
- Maintains reporting and analytical tools and communication processes to help track, manage, and report on disputes, insolvencies, and other matters in which the Company has a financial or reputational interest; and
- Provides qualitative reporting with respect to major or contentious claims to the SVP, Chief Counsel – Underwriting & Litigation for use in quarterly legal reports to senior management and the Board of Directors.
Education, Skills & Experience:
- Juris Doctor (J.D.), LL. B, or equivalent law degree from a highly respected and accredited law school.
- Minimum of seven (7) years of post-qualification legal experience, with significant experience as a practicing attorney or -in-house counsel supporting the insurance and reinsurance industry.
- Extensive experience managing and leading the arbitration and litigation of complex insurance and reinsurance disputes in the United States through evidentiary hearings, trial, and appeal proceedings.
- Deep understanding of reinsurance legal principles, including contract interpretation, coverage disputes and claims management.
- Proven experience advising on the legal aspects of run-off strategies, legacy portfolios, and the resolution of sidecar and third-party capital vehicles, including related contractual, regulatory, and dispute considerations.
- Exceptional legal research, analytical, drafting, and negotiation skills, with the ability to deliver clear, practical, and commercially focused advice on complex matters.
- Strong project management, organizational, and stakeholder management capabilities, with the ability to coordinate cross-functional teams across multiple jurisdictions.
- Demonstrated experience presenting, training, and speaking on highly technical insurance and reinsurance topics to internal and external audiences, including the development of educational materials and thought leadership.
- Demonstrated proficiency in leveraging technology-enabled legal tools to legal work in the reinsurance underwriting context.
