VP Litigation Counsel
Genesee & Wyoming Inc.SUMMARY:
Responsible for litigation work involving the Company and its affiliates, assisting in the resolution of disputes arising out of a variety of factual circumstances, including FELA, OSHA, EEOC, commercial, regulatory and third-party claims. When the dispute between the parties is not settled by a mutual agreement, outside litigation attorneys are engaged under management of Litigation Counsel. Representing clients and supervising them in litigation, regulatory, and enforcement proceedings and internal investigations are the basic responsibilities of the litigation counsel. The attorney also participates in business disputes, contested matters, and management of litigation and regulatory risks. Coordinating with compliance department in regulatory and enforcement matters, identifying litigation and regulatory risk factors and monitoring legal and regulatory developments is also part of a litigation attorney’s duties. A litigation attorney can provide their services in a range of areas including corporate, human resources, OSHA, bankruptcy, environmental, real estate and commercial matters.
RESPONSIBILITIES:
- Oversight of pending and threatened litigation matters, including providing liability analysis to business clients regarding threatened or pending litigation matters.
- Responsible for all aspects of case management, including the financial analysis and reserve establishment.
- Collaborating with, directing and managing outside counsel and e-discovery vendors.
- Conducting factual reviews and investigations in connection with a wide range of legal issues.
- Assisting in the resolution of disputes pre-litigation, including communicating and negotiating with claimants and/or their representatives.
- Responsible for coordinating responses to subpoenas served on the company or its affiliates.
- Devise litigation strategy; review, revise and provide substantive input on all litigation submissions; manage discovery; attend hearings and mediations; manage costs and budgets; and report to and update supervisor and senior executives on litigation matters.
- Develops and/or oversees the defenses of the organization in lawsuits and evaluates the organizations outside counsel to ensure competent and cost-effective representation across the various jurisdictions. Coordinates case handling with outside counsel.
- Provide prompt reporting to management on litigation developments and furnish advice and counsel on appropriate defense and resolution strategies.
- Develops a pro-active litigation approach to manage risk and minimize costs.
- Manage pre-litigation claims with the objective of minimizing costs and preventing future litigation.
- Familiarity with liability, property and employment practices insurance, with a focus on loss recovery through insurance, when applicable.
REQUIRED SKILLS AND/OR EXPERIENCE:
- The candidate should have four-year bachelor’s degree or international equivalent education, along with a JD degree. In-house litigation management experience is preferred, including 8 years of relevant experience. Along with good questioning and reasoning skills, excellent communication and inter-personal skills are also important for the position.
REQUIRED EDUCATION AND/OR CREDENTIALS:
- JD degree from a top US school.
- Bar admission in at least one state and in good standing.
