Brief Job Description:

 

The Texas Health and Human Services Commission (HHSC) Office of Inspector General (OIG) seeks an eDiscovery Project Manager (Project Manager IV) to join the Chief Counsel's Litigation section. The eDiscovery Project Manager will perform highly advanced (senior-level) technical and project management work, utilizing eDiscovery applications and other litigation support technology in support of litigation matters, investigations, and other projects.

 

Responsibilities will include:

 

Coordinating the planning, initiation, and management of eDiscovery and litigation support projects; monitoring the progress and schedule of projects; and meeting established goals and deadlines. Taking an active role in the collection, management, processing, and production of documents and data.

 

Managing the deployment, integration, and ongoing administration of a new eDiscovery solution.

 

Developing policies and training materials; training attorneys, investigators, and legal staff on eDiscovery concepts, best practices, software, and systems; and collaborating with internal information technology (IT)  teams and vendor consultants.

 

Providing technical assistance in all areas of litigation support, including data management and courtroom support. Developing demonstrative exhibits, presentations, reports, and analyses.

 

The eDiscovery Analyst will report to the Office Manager and work under the general direction of the Director of Litigation, with considerable latitude for the use of initiative and independent judgment.

 

Essential Job Functions (EJFs):

 

Evaluate eDiscovery and litigation support needs, interpret project requirements, and advise litigation teams on best practices and standard technical approaches. Develop project plans and schedules. Coordinate and participate in team meetings to identify project scope, key milestones, and deadlines. Utilize eDiscovery technology, methodologies, processes, and best practices to achieve project completion. Coordinate internal legal and support resources as well as vendor resources to participate in complex projects as needed. Anticipate and proactively problem-solve case team needs. (20%)

 

Collaborate with legal teams, internal IT teams, and vendor consultants to deploy and integrate new eDiscovery solutions. Administer, support, and maintain the eDiscovery platform hardware, software, application, and data, with the support of appropriate internal and vendor resources. Identify, analyze, and solve end user problems and resolve issues related to eDiscovery applications and database issues. (20%)

 

Handle large datasets collected internally and shared between parties. Perform activities including but not limited to data processing, loading into database applications, imaging, and building production subsets. Perform data analysis using industry standard tools and software; present findings in the format requested. Utilize e-discovery tools to manage, cull, and analyze large volumes of ESI effectively. Prepare data for examination, review, and production. Document and report on all e-Discovery activities. Track data collected. Track incoming and outgoing production. Preserve and document chain of custody. Prepare privilege logs. (20%)

 

Develop agency processes and procedures for eDiscovery. Produce system documentation and training materials. Implement quality control processes to ensure accuracy and defensibility. Write guidelines, summaries, and proposals. Train legal teams on eDiscovery applications and tools, the Electronic Discovery Reference Model (EDRM), and effective methods of document review. (15%)

 

Collaborate with attorneys, legal staff, program areas, and IT to ensure proper data preservation, collection, processing, review, and production. Coordinate with HHSC Office of Chief Counsel, the Office of Attorney General, and IT teams to implement legal holds. (10%)

 

Create audio/visual and graphic trial exhibits and demonstrative evidence to support arguments in court. Provide technical assistance with courtroom technology, databases, and other digital tools to attorneys and legal staff. (5%)

 

Maintain relevant knowledge necessary to perform essential job functions. Proactively monitor trends and emerging capabilities for litigation support and eDiscovery technology. Research, evaluate and recommend new hardware, software, services, and other resources that would benefit the OIG’s mission. (5%)

 

Perform related work as assigned. Keep supervisor informed as required or as necessary. (5%)

 

Knowledge, Skills, and Abilities:

 

Knowledge of legal principles, practices, proceedings, and terminology as related to litigation support and eDiscovery

 

Knowledge of eDiscovery processes, workflows, compliance requirements, and lifecycle

 

Knowledge of document review platform best practices

 

Knowledge of the Electronic Discovery Reference Model (EDRM)

 

Knowledge of technology-assisted review (TAR) principles and methodologies

 

Knowledge of project management methodologies

 

Knowledge of information security procedures, concepts, laws, and requirements related to protecting highly-sensitive healthcare, financial, criminal justice, and privileged information

 

Knowledge of requirements set forth under the Health Insurance and Portability Accountability Act (“HIPAA”), Criminal Justice Information Services (“CJIS”) Security Policy, Payment Card Industry Data Security Standard (“PCI DSS”), and other industry standards

 

Knowledge of general procurement processes, including development of solicitations, evaluation of goods or services, and assessment of best value

 

Skill in communicating professionally and effectively orally and in writing and in presenting information

 

Skill in organizing and leading project teams

 

Skill in planning, developing, managing, executing, and completing complex projects

 

Skill in use of computer software applications including, but not limited to Microsoft Office (Outlook, Word, Excel, PowerPoint, Visio, and Teams), Adobe Acrobat Pro, data analytics tools, and database programs

 

Skill in use and administration of eDiscovery systems and software, including but not limited to Relativity, RelativityOne, Everlaw, Clearwell, Encase, or similar technologies

 

Skill in developing advanced search strategies, building complex queries, and use of Boolean operators

 

Skill in use of trial presentation software, including but not limited to Sanction, OnCue, Trial Director, ExhibitView, or similar technologies

 

Skill in coordinating with legal teams, internal and external stakeholders, IT teams, and vendors on litigation and discovery issues

 

Skill in drafting, proofreading, editing, formatting, and finalizing documents, including, but not limited to policies, procedures, training materials, presentations, spreadsheets, and reports

 

Skill in training attorneys, legal staff, investigators, non-legal personnel, and others on ediscovery concepts, methodologies, processes, and technology

 

Skill in handling multiple tasks, prioritizing, and meeting deadlines

 

Skill in exercising sound judgment and effective decision making

 

Skill in collaborating and establishing and maintaining effective working relationships

 

Ability to establish project goals and objectives, manage project activities, and complete projects in accordance with established deadlines

 

Ability to administer, support, and maintain the eDiscovery platform hardware, software, application, and data

Registrations, Licensure Requirements or Certifications:

 

Project Management Professional (PMP) certification is preferred.

 

Initial Screening Criteria:

 

Graduation from an accredited college or university with a major in computer science, management information systems, business administration, or a related field is generally preferred.

 

Any one of these criteria could substitute for up to two years of college:

 

  • Certified E-Discovery Specialist (CEDS) certification (Association of Certified E-Discovery Specialists)

 

  • Relativity or other eDiscovery platform administrator or user certification

 

  • Two additional years of full-time professional eDiscovery project management (or closely related litigation support) experience in a legal practice environment.

 

Seven years of full-time, professional, hands-on eDiscovery project management (or closely related litigation support) experience using Relativity, RelativityOne, Everlaw, Clearwell, or similar eDiscovery platforms, to include five years of full-time professional experience in a legal practice environment, including but not limited to a government agency, law firm, or corporate law department.

 

Additional Information:

 

The OIG is responsible for preventing, detecting, auditing, inspecting, reviewing, and investigating fraud, waste, and abuse in the provision of HHS in Medicaid and other HHS programs. Potential employees of OIG are subject to criminal background checks in accordance with the HHS Human Resources policy. Selected applicants must complete a national fingerprint-based criminal background check through the Texas Department of Public Safety (TDPS) and Federal Bureau of Investigations (FBI) to determine if they have criminal history record information that constitutes a bar to employment.
