Who we are looking for:

We are seeking a Commercial Disputes & Litigation Counsel to join our Legal team and assist with the Company’s overall disputes and litigation management. This role is an important member of the Legal team responsible for driving and building upon our overall commercial disputes strategy, dispute resolution, and day-to-day litigation management. A successful candidate will be a strategic business focused thought leader while supporting the day-to-day needs of the litigation team in its current state and as it grows. This role will report directly to the Assistant General Counsel – Litigation & Employment.

 

What you will do:

  • Advise on litigation strategy and actively manage day-to-day dispute and litigation (including pre-litigation) matters that affect ACV and/or its family of companies, including drafting and responding to discovery requests; preparing court filings and briefs, preparing witnesses and attending/conducting depositions; attending court as necessary; and responding to third-party subpoenas.
  • Partner closely with internal business teams to proactively support, address, and resolve day-to-day business dispute needs, including providing timely, accurate, and business-oriented legal advice to operations and customer-facing departments, with a focus on clear, concise communications.
  • Analyze and assess potential litigation risks and identify creative solutions to legal issues that prioritizes realistic operationalization and company risk profile and tolerance levels.
  • Handle and/or assist with handling, arbitrations, mediations, and, at times, investigations.
  • Manage litigation holds and the collection and review of documents and data for discovery, including through our eDiscovery vendor.
  • Develop and manage a nationally disbursed panel of outside counsel.
  • Partner with business units in the development and improvement of litigation policies and processes, including litigation holds, eDiscovery, and subpoena responses.
  • Develop and maintain litigation management tools and metrics that tracks status and monitors trends on the Company’s litigation portfolio.
  • Provide status updates and litigation reports to key stakeholders on a periodic and as needed basis.
  • Stay current on emerging litigation trends, tools, and laws that may impact ACV.
  • Other duties as assigned.

 

What you will need:

  • Minimum 7 years commercial litigation experience, including at least 3 years of litigation management experience in an in-house setting.
  • Proven track record of handling litigation functions in an in-house setting required, preference given to companies in the technology space and with b2b customers.
  • Must be able to apply strong business acumen to legal advice.
  • Adaptable and resilient with ability to understand real risk and apply logical solutions.
  • Experience litigating a variety of commercial and contractual disputes on both plaintiff and defendant side. Experience in debt collection is helpful.
  • Understanding of end-to-end litigation process, legal research, eDiscovery, and contract drafting and interpretation.
  • Ability to work well under pressure with diligence, organization, and minimal supervision, and provide practical, business-friendly advice to clients in clear, concise communications.
  • Strong analytical and strategic skills; ability to drive issues to a quick resolution that factors in business objectives.
  • High degree of professional ethics and integrity.

 

Physical/Mental requirements:

  • Must be able to remain in a stationary position for 50% or more of the work day.
  • Ability to use computer, including typing, navigating software applications, and using a mouse or track pad
  • Analytical thinking and problem-solving ability.
  • Ability to communicate and effectively exchange information, orally and in writing

 

Compensation: $153,000 - $191,000 annually. Please note that final compensation will be determined based upon the applicant's relevant experience, skillset, location, business needs, market demands, and other factors as permitted by law.
